What is a testamentary trust?

A testamentary trust is created by your will and only comes into effect after your death. Trustees you choose hold assets for the people you name, under the rules you set out.

Common reasons include providing for young children until they reach an age you choose, supporting a surviving partner while protecting the eventual inheritance for your children, or providing for a beneficiary who may need support managing money.

We explain trusts relevant to estate planning and include appropriate testamentary trusts within wills.
